The Commercial Warranties as a Tool of Consumer Protection

The effectiveness of resource allocation requires rational decisions. The consumers decide in direct and indirect way on what and how many goods are produced in the market economy. Rationality of decisions is often low because of unbalance of market force between producers and consumers. The unbalance leads to the lost of consumer profits and social welfare decrease. The UE consumer interests are protected in the mandatory and voluntary ways. The mandatory tool of consumer protection are legal quarantines. However some entrepreneurs stand forth and offer voluntary commercial warranties as well. The main aim of the research is to compare the level of consumer protection from legal guarantees to commercial warranties in Poland against the background of the UE Members. In his research, the author used the information coming from the law on consumer rights, results of his examination of household products warranties, and the results of the checks conducted by the ECC-Net. The research shows that the legal guaranties offer higher protection than commercial warranties therefore the consumers should use them first of all.
